VA's only enforcement action is to withhold payments to force these state veterans homes to comply, but VA considers this too severe for most situations. VA officials are considering asking Congress for more enforcement authorities. Add to this quotient the amount based on the CMS payment schedule for physician services. The resulting sum is the per diem baseline rate for the State home. In determining the baseline for this formula, we would use the rate for FY 2023 because we anticipate this rulemaking to be finalized and effective on or before October 1, 2023, which is the first day of FY 2024. Therefore, we established an agreement with CMS to obtain average market basket data needed to continue providing an annual per diem rate until this rulemaking is finalized.
The other two tiers are “Basic” and “Housebound.” Each tier has a different level of benefits and qualification. In the event a veteran or their spouse doesn’t qualify for A&A, they’re encouraged to look into the Basic and Household tiers. According to the VA, the A&A is one of the agency’s lesser known benefits.

Primarily, VA will not adopt the PDPM formula because this formula is focused on incentivizing providers to take on new patients, which is not an issue VA faces with State homes that provide nursing home care. An additional reason is that the PDPM model is specific to the needs of CMS facilities, rather than State homes. For example, under Medicare, CMS only pays for the first 100 days of skilled nursing home care. After which, the patient's care must be paid for by another source ( i.e.,private, insurance, Medicaid), or the patient is discharged.

The State homes program is the largest provider of long-term care for our Nation's veterans with more than 162 State homes across all 50 states and Puerto Rico, totaling over 30,000 beds. They provide skilled nursing care, domiciliary care, and adult day health care to both veterans and non-veterans. Each State home is owned, operated, and managed by each State's government. After certification, VA reviews each State home annually to ensure continued compliance with VA's requirements and standards. These services are either directly offered by the VA, but the VA also collaborates with other community-based agencies. The Department of Veterans Affairs is the only federal entity that oversees all 153 state veterans homes, which provide nursing home care to roughly 14,500 veterans.

To participate in the State Veterans Home program, the VA must formally recognize and certify a facility as a State Veterans Home.

You may also be able to seek financial assistance with these services through private insurance companies such as Medicaid or Medicare. Any veteran who is eligible for, and consequently receives nursing home care, could have their monthly pension reduced. This group of people will be considered a “priority group” in the eyes of the VA while considering nursing home care. This means that their needs will take priority over the needs of others. However, when everyone under this priority group receives the care they require, other candidates will be provided for, if the VA has enough resources to support them. In 2017, VA introduced plans to dramatically expand telehealth—also known as “anywhere to anywhere”—health care services.
You can continue to receive an aide's services for as long as you need extra help with your daily activities. A copay for Homemaker and Home Health Aide services may be charged based on your VA service-connected disability status. Nursing home care in public or private nursing homes is also available to some veterans. Stays in these nursing homes can be limited, however, for veterans with ratings less than 70% and for veterans who do not need care due to a service-connected disability. The Department of Veterans Affairs provides both short-term and long-term care in nursing homes to veterans who aren't sick enough to be in the hospital but are too disabled or elderly to take care of themselves. Priority is given to veterans with service-connected disabilities. The Aid and Attendance and Housebound Improved Pension is perhaps the most important benefit yet also the one most misunderstood by the public. Available for any veteran age 65 or older with 90 days of previous military service, including at least one day of wartime service, the A&A provides a variety of options for long-term care.

Lawmakers need to pass either the full fiscal 2023 appropriations bill or a short-term budget extension by midnight Friday or risk triggering a partial government shutdown due to a lack of available funding for federal operations. GAO's analysis of VA's available annual inspection data for 2019 and 2021 found increases in both the number and the severity of deficiencies cited. For example, the total number of deficiencies increased from 424 in 2019 to 766 in 2021. A majority of the increase was in the quality of care and infection control categories, which cover accidents and staff hand hygiene. Additionally, GAO found that, for those homes with annual inspection data available in both 2019 and 2021, many were cited for deficiencies in the same standard.

As a Veteran, you may be able to get assisted living, residential (live-in), or home health care through VA. There are other veterans benefits that pay you money for private-pay nursing home care, assisted living, home care and other long term care needs. A Place for Mom uses the term “assisted living” to indicate that the community provides some level of assistance with daily living activities. It does not indicate that the facility meets official state requirements for level of care.
